Introduction
This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and Alpas Technology Pvt. Ltd. (“Company,” “we,” “our,” or “us”) regarding your use of the CiviAlert mobile application (“Application” or “App”).
By downloading the licensed Application from Apple’s software distribution platform (“App Store”) or Google’s software distribution platform (“Play Store”), including any updates thereto (as permitted by this License Agreement), you indicate that you agree to be bound by all of the terms and conditions of this License Agreement and that you accept this License Agreement. App Store and Play Store are collectively referred to in this License Agreement as the “Services.”
If you do not agree to this Agreement, do not use the App.
1. License Grant
The Company grants you a limited, non-exclusive, non-transferable, and revocable license to install and use the Application on devices that you own or control. This license includes any updates, upgrades, or supplements provided by the Company for the Application, unless a separate license is provided.
2. User Obligations and Restrictions
- Personal Use Only: You may use the Application solely for your personal, non-commercial purposes.
- No Redistribution: You may not sell, rent, lease, lend, sublicense, or otherwise distribute the Application to third parties, except as permitted by the Services or with the Company’s prior written consent.
- No Reverse Engineering: You may not reverse engineer, decompile, disassemble, adapt, modify, or attempt to derive the source code of the Application, except where expressly permitted by law or with the Company’s prior written consent.
- Copying and Backup: You may make copies of the Application only for backup or archival purposes on devices you own or control, and you may not allow unauthorized third parties access to such copies.
- Compliance with Third-Party Terms: You must comply with all applicable third-party terms when using the Application.
- Update and Technical Specifications: The Company will attempt to keep the Application updated to maintain compatibility with new firmware and hardware versions. You are responsible for ensuring your device meets any technical specifications required for proper use. The Company may modify technical specifications as necessary.
- Enforcement: Violations of these obligations may result in termination of your license and possible legal action.
3. Use of the Application
- The App allows users to report and document civic issues, including the option to upload photos and videos to support reports.
- The App requires to use your device’s location services to send incident reports with geographic information.
- The Application is not an emergency response service and must not be relied upon as a substitute for contacting official emergency services.
4. Disclaimer Regarding Services
- The Application does not connect to police, fire, ambulance, or other emergency services.
- In the event of an emergency, you must immediately contact your local authorities by dialing the official emergency number.
- The Company does not guarantee that reported issues will be received, reviewed, or acted upon by any authority.
5. User Responsibilities
- Provide accurate, lawful, and non-abusive information when submitting reports.
- Do not upload offensive, harmful, or false content.
- Maintain the security of your account and device.
6. Data Collection and Privacy
- The App collects provided information, including location, photos, videos, and descriptions you provide.
- Collected data is used to improve the reporting experience and will not be sold to third parties without your consent.

7. Intellectual Property
The Application and its contents, features, and design are owned by Alpas Technology Pvt. Ltd. and protected under copyright and intellectual property laws.
8. Limitation of Liability
- The Application is provided “as is” and “as available” without warranties of any kind.
- The Company is not responsible for delays, failures, or the lack of action taken by authorities or third parties regarding issues reported via the Application.
- To the maximum extent permitted by law, the Company disclaims liability for any damages resulting from the use or inability to use the Application.
9. Termination
The Company may suspend or terminate your access to the Application at any time for violation of this Agreement or misuse of the Application.
10. Governing Law
This Agreement is governed by the laws of Nepal, subject to applicable consumer protection laws.
11. Amendments
The Company may update this Agreement periodically. Continued use of the Application constitutes acceptance of the revised terms.
